OFFICIAL RULES & REGULATIONS FOR THE MERCER "Show Us Your Truck" CONTEST

  1. HOW TO ENTER:

    Visit www.showusyourtruck.com and submit photo entries online. Mail photo entry to: Mercer Transportation Co. c/o Showusyourtruck.com, 1128 West Main St., Louisville, KY 40203. Contestants must provide their name, e-mail address, daytime telephone number, address and a brief description of their truck when submitting a photo for entry into the contest. Mercer has the right disqualify incomplete submissions. Photo submissions must be clear and discernable. Mercer has the right to disqualify a submission based on the quality of the photo(s). If a contestant submits more than one photo, Mercer will choose the most appropriate photo(s) to be showcased on the website. All photographic entries and their content become the property of Mercer Transportation and will not be returned. Photos may be submitted in either category: Mercer fleet (trucks leased to Mercer owner operators) or "The Best of the Rest" (trucks not leased to Mercer Transportation.) Mercer Transportation Co., Inc. is not responsible for online entries not received due to difficulty accessing the Internet, computer malfunctions, telephone service outages, delays, busy signals, equipment malfunctions and any other technical difficulties.  Mercer Transportation Co., Inc. also not responsible for lost, stolen, misdelivered, incomplete or late entries, defective or unreadable entries, equipment malfunctions, technical problems relating to submissions or any other difficulties regarding the photo entries.

    Mercer Transportation Co., at its sole discretion, reserves the right to disqualify any photographic entry if the entry contains material whose content is deemed at the sole discretion of Mercer to be unsuitable for public viewing or posting via the internet.

  2. CONDITIONS:

    By participating in the contest, winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

    All profits from any sale of the photo will go to Mercer Transportation Co.  The sole financial consideration for the entrant is the prize. Photos may be displayed at Mercer trade show booths, reproduced in promotional material and/or on the Mercer websites, www.mercertown.com or www.showusyourtruck.com.

    Mercer Transportation Co., in its sole discretion, reserves the right to disqualify any person tampering with the entry process; the operation of the Showusyourtruck website or is otherwise in violation of the rules. It further reserves the right to cancel the contest for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

    Mercer Transportation reserves the right to make changes in the rules of the contest including the substitution of a prize or prizes of equivalent value, which will become effective upon announcement.  If due to circumstances beyond its control, Mercer reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.

    By participating, the entrant agrees to abide by and be bound by these rules. Prize Winners must agree to satisfy all conditions and terms of prize established by the contest sponsors, and must execute any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form before any prize is awarded.

  3. ELIGIBILITY:

    The contest is open to all truck owners who can provide a valid government-issued picture ID. Contestants must be able to provide proof of ownership of equipment featured in photo entry. Truck must be in working condition. Contestants are required to provide truthful information and Mercer will reject and delete any entry that it discovers to be false or fraudulent. Mercer will disqualify any entry from individuals who do not meet the eligibility requirements. Winners must meet all eligibility requirements to receive any prize package.

  4. PRIZES:

    Every month, starting in January of 2008, two monthly winners (one winner from each category) will receive a $200 gift certificate to Four State Trucks, America’s heavy-duty truck parts super store. Gift certificates may be redeemed on the websites www.4statetrucks.com and www.chromeshopmafia.com or at the retail store located in Joplin, MO.

    Monthly winners will be inducted into the “winner’s circle” to be eligible for the grand prize drawing in January 2009. The winner will be drawn at random. Grand prize details are to be announced.

    Prize Winners must agree to satisfy all conditions and terms of prize established by the contest sponsors, and must execute any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form before any prize is awarded.

    There are no substitutions, transfers or cash equivalents for prizes, except that Mercer may, at its sole discretion, substitute prizes of comparable value or cash.  The prizes are expressly limited to the item(s) announced at the time the contest is run and do not include taxes, gratuities or any other expenses.  Other restrictions may apply.

  5. PRIZE DRAWING AND NOTIFICATION:

    Decisions of Mercer with respect to the contest are final. Winners will be contacted via telephone and email.

    A panel of judges, selected at the sole discretion of Mercer, will select one winning truck in each category, that best represents the category, from all of the photo entries received for each respective category.  The person submitting the winning entry in each category will be deemed a winner. Judging will be based on the truck’s overall appearance in the photograph(s) and extra points will be credited for classic styling.

    All prizes may be mailed to the winners. If a prize is mailed, it will be with the prior consent of the winner; and therefore, the winner assumes the risk of its loss.  Mercer Transportation is not responsible for the safe or timely arrival of a prize. Prizes may also be picked up at the office of Mercer Transportation Co., 1128 West Main Street, Louisville, KY, 40203 during business hours, which are Monday – Friday, 8 a.m. – 5:00 p.m.  Prizes must be claimed within thirty (30) days of winning.  Prizes not claimed within the stated time limit will be forfeited. Forfeited prizes become the property of Mercer. 

    Mercer reserves the right to not choose a winner in any category if no submitted entries satisfy judging criteria or if no eligible photos are submitted.

  6. WINNERS LIST:

    A winners list, along with the winning submissions, will be posted during the first week of each month on the winners section of Showusyourtruck.com.

By use of this website and by entering the Contest, you agree to the Showusyourtruck.com Contest Rules. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of Mercer Transportation Co., Inc.
